THE TREASURE TROVE

 

“I am a driver of excavator. Some months ago I used to work in one suburb. I used to de destroy old houses in place of which there should be constructed new buildings. One night I saw in my dream that I was sitting on a nice box. Then the box has been opened and a guest came out of that box and gave me the box. But I was afraid of the guest and did not take the box. One part of the wall has shined in the morning during the destroying of it. When I approached to the wall it was turned out that there was a ceramic pitcher in the wall. The tractor had broken the pitcher and some yellow metals had fallen down. Soon it was discovered that those were golden bars, money and jewelry. The mass was nearly 10 kilos. I had called my boss. And suddenly a sixty-year-old man appeared and declared that he is the owner of that land and ordered the people who were with him to gather all the golden things. They did and left.  My boss had promised me that I would have a share from that. After one week he had given me 1000$ and advised me to forget about the event. When I had demanded that I should get more he said that I would never get anything and showed the combination of three fingers”.

What was discussed above is called treasure which is regulated by law in the following way:

Treasure trove, i.e. money or valuable objects buried in the ground or in other property or hidden in another manner whose owner cannot be established or by virtue of a statute has lost the right of ownership to them, shall go into the ownership of the person to whom the property (land parcel, structure, etc.) belongs, where the treasure trove was hidden and the person who found the treasure trove in equal ownership shares unless an agreement between them provides otherwise.

In case of discovery of a treasure trove by a person who has made excavations or a search for valuables without the consent of the owner of the land parcel or other property where the treasure trove was hidden, the treasure trove shall be subject to transfer to the owner of the land parcel or other property where the treasure trove was discovered.

 

You should know!

The treasure trove containing property that classified as items of historical or cultural value is state property. In such a case the owner of the land parcel or other property where the treasure trove was hidden and the person who have found the treasure trove have the right to receive jointly a remuneration in the amount of fifty percent of the value of the treasure trove.

The remuneration shall be distributed among these persons in equal ownership shares unless an agreement between them has established otherwise.

The rules of the present Article shall not be applied to persons in the scope of whose labour and employment duties were included the conduct of excavations and search directed at finding treasure trove.
